Welcome to Mudbug Bourré (the “Service”), an online version of the Cajun card game Bourré operated by Mudbug Software, LLC (“we,” “us,” “our”). By creating an account, signing in, or otherwise using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority where you live) to use the Service. The Service is a game of skill and entertainment; it is not a gambling service, offers no prizes, and provides no way to win or withdraw real money.
You may sign in with Google or with an email and password. Keep your credentials secure; you are responsible for activity on your account. Provide accurate information, keep one account per person, and notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Mudbug Dollars (“M$”) are a free, virtual, in-game score — a way to keep score at the tables and on the leaderboard. M$ are never sold, and M$ are never money. M$:
Because M$ can never be exchanged for anything of value, and because the Service never pays anything of value out to any player, Mudbug Bourré is a game of score — not gambling.
M$ are revocable scorekeeping entries in our database. They are not property, currency, credit, or a stored-value instrument, and they create no property, license, contractual-payment, or ownership right of any kind. We may grant, adjust, reset, or revoke M$ at any time — for example, starting grants, corrections, resets between phases of the Service, or to address fraud or abuse. Access to the Service is provided through a paid subscription (see Section 4); paying for access never buys, includes, or increases M$.
Every new account receives a free starting amount of M$, and you may refill your M$ on hand at any time, at no charge and with no waiting period or eligibility condition, up to a ceiling on the amount you may hold at once. A refill is free and creates no repayment obligation of any kind; because M$ are only points, a refill never improves your standing. Your standing simply reflects how you have done at the tables, and is a measure of skill and nothing more. There are no prizes and no cashouts, ever.
M$ never control access. M$ are only a score, and the amount of M$ you hold never gates or restricts anything on the Service. Running out of M$ will never prevent, delay, or restrict your play, your choice of table, or your entry into any tournament — you may simply refill your M$ on hand at will and continue.
Mudbug Bourré is played for score and enjoyment only. We do not award cash, gift cards, merchandise, free subscriptions, subscription extensions or credit, discounts, or entries into any prize drawing — and we award nothing of value — based on your M$, your leaderboard position, or your tournament results.
You also agree that you will not, in connection with the Service:
These activities are prohibited whether or not they involve M$, and we may suspend or terminate any account involved in them.
Access to the Service is offered by paid subscription — currently US$5.00 per month or US$50.00 per year. Subscriptions are processed by our third-party payment provider and renew automatically until canceled. You may cancel at any time; your access continues through the end of the period you have already paid for and does not renew after that.
All payments are final and non-refundable, except where a refund is required by law. A subscription pays only for access to the Service; it does not buy, include, or increase Mudbug Dollars (see Section 3), which are always free and never sold. Suspending or terminating your account for a violation of these Terms does not entitle you to any refund.
The Service may be offered as a beta. Features, balances, and promotional grants may change, be reset, or be removed at any time. Beta grants of M$ are promotional and have no cash value.
You agree not to: cheat, collude, or exploit bugs; use bots, scripts, or automation to play; interfere with or attempt to disrupt the Service; access other users’ accounts or data; reverse-engineer or resell the Service; or use the Service for any unlawful purpose.
Table chat is a shared, moderated space. You agree not to post content that is harassing, hateful, threatening, obscene, defamatory, or otherwise abusive, and not to spam, impersonate others, or share others’ private information. Chat may be automatically filtered, and other players may mute or report you. We may review reported messages and, at our discretion, mute or suspend (ban) any account for conduct that violates these Terms. Suspension may remove your access to the Service, and, consistent with Section 4, does not entitle you to a refund.
If you upload a custom avatar or other image, you represent that you have the right to use it and that it is not obscene, hateful, harassing, infringing, or otherwise objectionable, and does not depict or impersonate another person without their consent. Other players may report an avatar. We may, at our discretion, remove or reset any avatar and mute or suspend (ban) the account, consistent with Section 6a. Uploaded images are re-encoded on our servers; you grant us the limited right to store, resize, and display your avatar as part of operating the Service.
The Service, including its software, artwork, and content, is owned by Mudbug Software, LLC and its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Mudbug Software, LLC will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
We may suspend or terminate your access to the Service at any time for violation of these Terms or to protect the Service or other users. You may stop using the Service at any time. M$ associated with a terminated account are forfeited and are not refundable.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Louisiana, USA, without regard to its conflict-of-laws rules, and any dispute will be resolved in the state or federal courts located there.
